Data Protection Privacy Notice

The Asplins Producer Organisation Ltd is committed to safeguarding the privacy of its growers, customers and suppliers.  This Privacy Notice explains who we are, how we collect, share and use personal information about you, and how you can exercise your privacy rights.  Please read the following Privacy Notice carefully and if you have any queries or concerns about our use of your personal information please refer to “How to Contact us” towards the bottom of this privacy notice.

Who we are and what we do

The Asplins Producer Organisation Ltd (Asplins) is a fruit producing, packing and marketing co-operative with eleven Members who produce top, stone, and soft fruit across the UK. 

We are based at School Farm, Graveney Road, Faversham Kent ME13 8UP. 

Your rights in relation to personal information

Under the General Data Protection Regulation (GDPR) you are in control of your personal information and we respect your rights to access, correct, update or request deletion of the information we hold on you.  Should you need to contact us please refer to the “How to Contact us” section towards the bottom of this privacy notice.

In addition, you can object to the processing of your personal information, ask us to restrict processing of your personal information or request portability of your personal information. Again, you can exercise these rights by contacting us using the contact details provided.

Similarly, if we have collected and processed your personal information with your consent then you can withdraw your consent at any time. Withdrawing your consent will not affect the lawfulness of any processing we conducted prior to your withdrawal, nor will it affect processing of your personal information conducted in reliance on lawful processing grounds other than consent.

The personal information we collect and how we use it

Personal data is defined in the GDPR as “any information relating to an identified or identifiable natural person (‘data subject’); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person”. Information that you provide voluntarily

If you’re a grower, in order to sell your fruit we will ask you to complete a ‘Grower Account Details’ form which asks for your name, organisation and business e-mail address.

If you’re a customer or a supplier we will have obtained your name, organisation and business e-mail address in the course of our communications with you; either by telephone, by e-mail or by letter.

The information provided to us will be used to set up and administer your account. 

Information that we collect automatically

Use of IP Addresses

An Internet Protocol (IP) Address is a set of numbers that is automatically assigned to your computer whenever you log onto your internet service provider or through your organisation’s local area network (LAN) or wide area network (WAN).  Web servers automatically identify your computer by the IP address assigned to it during your session. Asplins may collect IP addresses for the purposes of systems administration and to audit the use of our websites.

The legal basis for processing your personal information

We will process your personal information where we have your consent or there is a contractual relationship; where we need the personal information to perform a contract with you or your organisation, or where the processing is in our legitimate interests and not overridden by your data protection interests.  In some cases we may also have a legal obligation to collect personal information from you. 

At the time of our request we will explain why we are requesting the personal information, whether the provision of the personal information is mandatory or not (as well as the possible consequences if you do not provide your personal information).

Sharing your personal information with third parties

We will treat all personal information confidentially and will only share it when necessary in order to conduct our business operations.

We may disclose your personal information to the following categories of recipients:

- to any competent law enforcement body, regulatory, government agency, court or other third party where we believe disclosure is necessary (i) as a matter of applicable law or regulation, (ii) to exercise, establish or defend our legal rights, or (iii) to protect your vital interests or those of any other person;

- to any other person with your consent to the disclosure.

Security of personal information

Asplins operates a secure data network protected by a firewall and password protection. There are security measures in place to attempt to protect against the loss, misuse and alteration of your user information under our control.  The measures we use are designed to provide a level of security appropriate to the risk of processing your personal information.  

Employees who have access to personal information have been trained to handle such information properly and in accordance with our security protocols and strict standards of confidentiality.  Although we cannot guarantee against any loss, misuse, unauthorised disclosure, alteration or destruction of data, we try to prevent such unfortunate occurrences.

Updates to this privacy notice

We may update this Privacy Notice from time to time in response to changing legal, technical or business developments.  When we update our Privacy Notice, we will take appropriate measures to inform you, consistent with the significance of the changes we make.   We will obtain your consent to any material Privacy Notice changes if and where this is required by applicable data protection laws.

Data Retention

The GDPR stipulates that we only retain personal information where we have an ongoing legitimate business need to do so.

We may retain personal information in order to comply with legal, tax or accounting requirements. 

When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymise it or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.  Any paper records we hold containing your personal information will be shredded.
